GENERAL CONDITIONS
1. GENERAL
1.1 These General Terms and Conditions apply if you, as a consumer, company or institution (Customer), make a purchase from Jennifer Huyer Art & Prints or in the Jennifer Huyer Art & Prints webshop on the website www.jenniferhuyer.com (Website). The General Terms and Conditions are published on the Website and can be sent by email at the Customer's first request.
1.2 The Website and all content on the Website is owned by Jennifer Huyer Art & Prints and protected by intellectual property rights, as is all the work of Jennifer Huyer Art & Prints. The copying and / or use of the aforementioned content and the work of Jennifer Huyer Art & Prints without the permission of Jennifer Huyer Art & Prints is not permitted.
2. THE OFFER
2.1 The offer of Jennifer Huyer Art & Prints is without obligation. Jennifer Huyer Art & Prints is entitled to change the offer.
2.2 All images on the Website and in the webshop have been published carefully and as truthfully as possible. This is not a guarantee that the image is an exact representation of the work.
2.3 An obvious mistake or error in the offer does not bind Jennifer Huyer Art & Prints.
2.4 Jennifer Huyer Art & Prints is not liable for errors on the Website and in the webshop. Jennifer Huyer Art & Prints has the right to change and update information and to correct errors. If the Customer makes a purchase based on an error on the Website or in the webshop, Jennifer Huyer Art & Prints will inform the Customer as soon as possible and the Customer has the right to cancel the purchase.
3. AGREEMENT
3.1 By purchasing via the Website or in the webshop, the Client and Jennifer Huyer Art & Prints conclude an agreement and the Client accepts the General Terms and Conditions. The purchase is the confirmation that the Customer has taken note of the General Conditions.
3.2 The agreement is only concluded after Jennifer Huyer Art & Prints has confirmed the purchase.
4. PRICES, COSTS AND PAYMENT
4.1 The price of the work is stated on the Website or in the webshop, in Euros including VAT, excluding shipping costs.
4.2 The payment options are listed on the Website and in the webshop. Jennifer Huyer Art & Prints has the right to change the payment method that the Customer selected at the time of purchase prior to delivery if that method does not work for any reason.
5. DELIVERY
5.1 Jennifer Huyer Art & Prints executes the agreement with the greatest possible care. Jennifer Huyer Art & Prints delivers the purchase within the period specified on the Website or in the webshop, unless another period has been expressly agreed. For paintings and Custom Made paintings, the delivery term that has been agreed with the Client applies.
5.2 If Jennifer Huyer Art & Prints foresees that the delivery term cannot be met, Jennifer Huyer Art & Prints will contact the Client and Atelier Andrea will make an effort to comply with the agreement. If delivery takes longer than 15 working days, the Customer can cancel the purchase, in which case Jennifer Huyer Art & Prints will refund the purchase price without any right to additional compensation.
5.3 Jennifer Huyer Art & Prints is not liable for a delayed delivery caused by third parties or circumstances over which Jennifer Huyer Art & Prints has no influence.
6. RIGHT OF WITHDRAWAL
6.1 After receipt of the purchase, the Customer can cancel the purchase without giving reasons within 14 days. The reflection period starts on the day after receipt of the purchase. The right of withdrawal does not apply to the Customer acting in the exercise of a profession or business.
6.2 If the Client makes use of the right of withdrawal, the Client will report this to Jennifer Huyer Art & Prints and the Client will return the purchase in its original condition and packaging to Jennifer Huyer Art & Prints according to the instructions of Jennifer Huyer Art & Prints.
6.3 The right of withdrawal does not apply to paintings and Custom Made paintings made by Jennifer Huyer Art & Prints. These works are custom-made and made by Jennifer Huyer Art & Prints on behalf of and exclusively for the Client.
7. WARRANTY AND COMPLAINTS
7.1 Jennifer Huyer Art & Prints guarantees that purchase complies with the agreement.
7.2 Defects or incorrectly delivered products must be reported by the Customer by email to Jennifer Huyer Art & Prints within 5 working days after receipt of the purchase.
8. CHANGES TO THE GENERAL CONDITIONS
8.1 The applicable General Terms and Conditions are published on the Website.
8.2 Jennifer Huyer Art & Prints has the right to change the General Terms and Conditions at any time. Changed terms and conditions apply from the moment the Customer has accepted the terms and conditions.
9. DISPUTES AND APPLICABLE LAW
9.1 Jennifer Huyer Art & Prints always strives to resolve disputes first in consultation.
9.2 Agreements between the Client and Jennifer Huyer Art & Prints are exclusively governed by Dutch law and in disputes only the Dutch court has jurisdiction, even if the Client does not live in the Netherlands.

ALGEMENE VOORWAARDEN
1. ALGEMEEN
1.1 Deze Algemene Voorwaarden zijn van toepassing als je als consument, bedrijf of instelling (Klant) een aankoop doet bij Jennifer Huyer Art & Prints of in de webshop van Jennifer Huyer Art & Prints op de website www.jenniferhuyer.com (Website).
De Algemene Voorwaarden zijn gepubliceerd op de Website en kunnen per email op eerste verzoek van de Klant worden toegestuurd.
1.2 De Website en alle inhoud op de Website is eigendom van Jennifer Huyer Art & Prints en beschermd door intellectuele-eigendomsrechten, net als al het werk van Jennifer Huyer Art & Prints. Het kopiëren en/of zonder toestemming van Jennifer Huyer Art & Prints gebruiken van het voormelde inhoud en het werk van Jennifer Huyer Art & Prints is niet toegestaan.
2. HET AANBOD
2.1 Het aanbod van Jennifer Huyer Art & Prints is vrijblijvend. Jennifer Huyer Art & Prints is gerechtigd het aanbod te wijzigen.
2.2 Alle afbeeldingen op de Website en in de webshop zijn zorgvuldig en zo waarheidsgetrouw mogelijk gepubliceerd. Dit is geen garantie dat de afbeelding een exacte weergave is van het werk.
2.3 Een kennelijke vergissing of fout in het aanbod bindt Jennifer Huyer Art & Prints niet.
2.4 Jennifer Huyer Art & Prints is niet aansprakelijk voor fouten op de Website en in de webshop. Jennifer Huyer Art & Prints heeft het recht informatie te wijzigen en te actualiseren, en fouten te corrigeren.
Doet de Klant een aankoop op basis van een fout op de Website of in de webshop, dan informeert Jennifer Huyer Art & Prints de Klant zo snel mogelijk en heeft de Klant het recht de aankoop te ontbinden.
3. OVEREENKOMST
3.1 Door de aankoop via de Website of in de webshop sluiten de Klant en Jennifer Huyer Art & Prints een overeenkomst en accepteert de Klant de Algemene Voorwaarden. De aankoop is de bevestiging dat de Klant kennis heeft genomen van de Algemene Voorwaarden.
3.2 De overeenkomst komt pas tot stand nadat Jennifer Huyer Art & Prints de aankoop heeft bevestigd.
4. PRIJZEN, KOSTEN EN BETALING
4.1 De prijs van het werk is vermeld op de Website of in de webshop, in Euro’s inclusief btw, exclusief verzendkosten.
4.2 De betaalmogelijkheden zijn vermeld op de Website en in de webshop. Jennifer Huyer Art & Prints heeft het recht de betaalmethode die de Klant bij de aankoop selecteerde, voorafgaand aan de levering te wijzigen als die methode om welke reden dan ook, niet werkt.
5. LEVERING
5.1 Jennifer Huyer Art & Prints voert met de grootst mogelijke zorgvuldigheid de overeenkomst uit. Jennifer Huyer Art & Prints levert de aankoop binnen de op de Website of in de webshop aangegeven termijn, tenzij een andere termijn uitdrukkelijk is overeengekomen.
Voor schilderijen en Custom Made schilderijen gelden de levertermijn die met de Klant is overeengekomen.
5.2 Voorziet Jennifer Huyer Art & Prints dat de levertermijn niet kan worden nagekomen, dan neemt Jennifer Huyer Art & Prints contact op met de Klant en spant Atelier Andrea zich in de overeenkomst na te komen.
Gaat de levering langer dan 15 werkdagen duren, dan kan de Klant de aankoop te annuleren in welk geval Jennifer Huyer Art & Prints de aankoopprijs terugbetaalt zonder dat een recht op aanvullende schadevergoeding ontstaat.
5.3 Jennifer Huyer Art & Prints is niet aansprakelijk voor een vertraagde levering die is veroorzaakt door derden of omstandigheden waar Jennifer Huyer Art & Prints geen invloed op heeft.
6. HERROEPINGSRECHT
6.1 Na ontvangst van de aankoop kan de Klant de aankoop zonder opgave van redenen binnen 14 dagen ontbinden. De bedenktijd gaat in op de dag na ontvangst van de aankoop.
Voor de Klant die handelt in de uitoefening van een beroep of bedrijf geldt het herroepingsrecht niet.
6.2 Maakt de Klant gebruik van het herroepingsrecht, dan meldt de Klant dit aan Jennifer Huyer Art & Prints en stuurt de Klant de aankoop in de originele staat en verpakking terug naar Jennifer Huyer Art & Prints volgens de instructies van Jennifer Huyer Art & Prints.
6.3 Voor door Jennifer Huyer Art & Prints gemaakte schilderijen en Custom Made schilderijen geldt het herroepingsrecht niet. Deze werken zijn maatwerk en in opdracht van en exclusief voor de Klant door Jennifer Huyer Art & Prints gemaakt.
7. GARANTIE EN KLACHTEN
7.1 Jennifer Huyer Art & Prints garandeert dat aankoop voldoet aan de overeenkomst.
7.2 Gebreken of verkeerd geleverde producten meldt de Klant binnen 5 werkdagen na ontvangst van de aankoop per email aan Jennifer Huyer Art & Prints.
8. WIJZIGINGEN IN DE ALGEMENE VOORWAARDEN
8.1 De geldende Algemene Voorwaarden zijn gepubliceerd op de Website.
8.2 Jennifer Huyer Art & Prints heeft het recht de Algemene Voorwaarden op ieder gewenst moment te wijzigen. Gewijzigde voorwaarden gelden vanaf het moment waarop de Klant de voorwaarden heeft geaccepteerd.
9. GESCHILLEN EN TOEPASSELIJK RECHT
9.1 Jennifer Huyer Art & Prints streeft er naar geschillen altijd eerst in goed overleg op te lossen.
9.2 Op overeenkomsten tussen de Klant en Jennifer Huyer Art & Prints is uitsluitend Nederlands recht van toepassing en is in geschillen uitsluitend de Nederlandse rechter bevoegd, ook als de Klant niet in Nederland woont.
